HOUSE NUMBER DISPLAY ORDINANCE #33

PREAMBLE

An ordinance to provide for the establishment, control and regulation of house numbering display within Markey Township, to provide for penalties for the violation of the Ordinance and to repeal any Township ordinance or parts of Township ordinances in direct conflict herewith.

The Markey Township Board has determined that the health, safety and welfare of the residents of Markey Township would be better served by the establishment of a uniform township-wide house number display system.  Such system will enable police agencies, ambulance services, fire services, public utilities, postal service, township officials, and other necessary services to more rapidly identify and locate properties within Markey Township.

SECTION I - Name

This Ordinance shall be known and cited as the "Markey Township House Number Display Ordinance."

SECTION II - Purpose

The purpose of this Ordinance is to establish a system within Markey Township whereby the addresses of all premises will be identified and to provide rules and guidelines to facilitate the enforcement thereof.

SECTION III - Definitions

A.  The term "premises" shall mean any lot or parcel of land owned by any person, firm or corporation, public or private, improved with building, whether occupied or unoccupied.

B.  The term "house number" shall mean the official number assigned that premises by Consumers Energy Company and recognized by the Roscommon County 911 Central Dispatch governing board.

C.  The term "street or road name" shall refer to any official name as recognized by governmental agencies.

SECTION IV - Regulation

A.  No street or road name shall be changed without the approval of the Markey Township Board, Roscommon County Road Commission, Consumers Energy Company and the Roscommon County 911 Central Dispatch governing board.

 

B.  Every premises shall display the distinctive house number assigned to that premises by Consumers Energy Company and recognized by the Roscommon County 911governing board.  The individual digits shall be no less than four (4) inches in height (three (3) inches if of a reflective material) in block style letters and shall be in a contrasting color to the background.  The house number shall be displayed in one of the following fashions:

1.   If the number is displayed on a house, the number shall be placed upon the front of the house in such a position as to be plainly visible to all traffic coming to the premises from either direction.

2.  If a house is more than 50 feet from the improved portion of the street or road or is not clearly visible from the street or road, the number shall be displayed on a sign adjacent to the street or road on which the property fronts.  Such sign shall be attached to a fence or post at a height that assures that the number will not be obscured by winter snows or snowplowing.

SECTION V - Violation

Failure to display a house number within (60) days after the adoption of this Ordinance, or in the case of new construction, prior to the issuance of a Certificate of Occupancy, shall be considered a violation of this Ordinance and shall be subject to penalties hereinafter provided.

SECTION VI - Saving Clause

The provisions of this Ordinance are hereby declared to be severable and if any clause, sentence, word, section or provision is declared void or unenforceable, for any reason, by a court of competent jurisdiction, the remaining portions of said Ordinances shall remain in full force and effect.

SECTION VII - Penalties

Any person, firm or corporation violating the provisions of this Ordinance shall be guilty of a misdemeanor subject to a fine of not more than one hundred dollars ($100) or imprisonment in the county jail for a period of not to exceed ninety (90) days, or both.  Such fine and imprisonment shall be at the discretion of the court.

Each and every day during which such violation continues shall be considered as a separate and distinct violation hereof and may be charged and prosecuted as such.  The above specified penalties may be imposed for each such violation.

SECTION VIII -  Effective Date

This Ordinance shall take effect 30 days following publication, as required by law, on July 24, 1999.

This Ordinance was adopted by the Township Board of the Township of Markey, Roscommon County, Michigan, at a regular meeting thereof held on June 14, 1999.  On a roll call vote, 5 aye votes were recorded.  No nay votes.
