Markey Township Zoning Ordinance #35Title and PurposeSection 1.01 Preamble In accordance with the authority and intent of Act 184 of the Public Acts of 1943, as amended, the Township desires to provide for its orderly development which is essential to the well-being of the community and which will place no undue burden upon developers, commerce, residents, food producers, the natural resources, or energy conservation. The Township further desires to assure adequate sites for commerce, food production, recreation, and residences; to provide for the free movement of vehicles upon the streets and highways of the Township; to protect commerce, food producers, natural resources, energy consumption and residences against incongruous and incompatible uses of land; to promote the proper use of land and natural resources for the economic well-being of the Township as a whole; to assure adequate space for the parking of vehicles for customers and employees using commercial and retail areas; to assure that all uses of land and buildings within the Township are so related as to provide for economy in government and mutual support; and to promote and protect the public health, safety, comfort, convenience and general welfare of all persons and property owners within the Township. Section 1.02 Enacting Clause The Township of Markey, County of Roscommon, State of Michigan, ordains: Section 1.03 Title An Ordinance enacted pursuant to the authority contained in Act 184 of the Public Acts of Michigan for 1943, as amended, known as the “Township Rural Zoning Act” for the establishment of zoning districts in the unincorporated portions of Markey Township, within the districts the use of commerce, forestry, recreation, residence, water supply conservation, and additional uses of land may be encouraged, regulated, or prohibited; for the adoption for such districts of provisions designating or limiting the location, height, number of stories, and size of dwellings, buildings and structures, including tents, recreation vehicles, and travel trailers which may hereafter be erected or altered; for the regulation of the area yards, courts, and measures that shall be required for such dwellings, buildings and structures, including tents, recreation vehicles, and travel trailers; for the designation of the maximum number of families which may be housed in buildings, dwellings and structures, including tents, recreation vehicles, and travel trailers; to provide regulation, as allowed in said Public Act 184, for the elimination, repair, or maintenance, of buildings and structures, and uses of land that are made non-conforming by the adoption of this Ordinance; to establish a Zoning Board of Appeals, and to grant authority to said Board in additional to that expressly provided in said Public Act 184; to provided standards to guide actions and decisions of said Board; to provide to the enforcement of the provisions of this Ordinance and penalties and other relief for the violation of said Ordinance; and to provide for the amendment thereof and the repeal of all Ordinance or parts of the Ordinance in conflict therewith. Section 1.04 Short Title This Ordinance shall be known as the “Zoning Ordinance of The Township of Markey,” and will be referred to herein as “the Ordinance.” Section 1.05 Scope It is not intended by this Ordinance to repeal, abrogate, annul or interfere with existing provisions of other laws or ordinances, except those specifically or impliedly repealed by this Ordinance, or with any private restrictions placed upon property by Covenant, deed or other private agreement unless repugnant hereto. Section 1.06 Control Where this Ordinance imposes a greater restriction than is imposed or required by such rules, regulations or private restrictions, the provisions of this Ordinance shall control.
